TERMS & CONDITIONS

1) In General

These terms and conditions, together with the Privacy & Cookie Policy govern how VOCLA Limited (‘VOCLA®’) conducts business with you in relation to www.VOCLA.com (the “Website”).

There are separate terms and conditions for the underwear subscription service: subscription terms and conditions.

The terms ‘VOCLA®’, ‘we’, ‘us’ and ‘our’ refer to the website owner, VOCLA Limited, whose registered office is Unit 2, Tilson Road, Roundthorn Industrial Estate, Manchester, M23 9GF, United Kingdom, and whose company registration number is 07910951, registered with the Registrar of Companies for England and Wales. 

The terms ‘you’ and ‘your’ refer to the user or viewer of the Website.

By using the services available through this Website (collectively, the ‘Services’) and purchasing products (collectively, the ‘Goods’), you are agreeing to all of the Terms and Conditions set out on this page and our Privacy Policy.

VOCLA® may change these Terms and Conditions at any time without prior notice. You should check this page regularly to take notice of any changes made. Your continued use of the Website after any such changes constitutes your acceptance of any new Terms and Conditions.

Where the Terms and Conditions require you to provide written notification to VOCLA®, this can be done by e-mailing contact@vocla.com.

 

2) Access to VOCLA.com

Access to this Website is permitted on a temporary basis, and we reserve the right to withdraw or amend the Services without notice. We will not be liable if for any reason this Website is unavailable at any time or for any period. From time to time, we may restrict access to some parts or to all of the Website.

 

3) Your Conduct

You must not misuse this Website. Unauthorised use of this Website may give rise to a claim for damages and/or constitute a criminal offence under the Computer Misuse Act (UK) 1990, as amended. VOCLA® will report any such breach to the relevant law enforcement authorities and disclose your identity to them. Breaches include, but are not limited to, the following:

– transmit or distribute a virus, trojan, worm, logic bomb or post any other material which is malicious, technologically harmful, in breach of confidence or in any way offensive or obscene;

– commit or encourage a criminal offence; corrupt data; hack into any aspect of the Service;

– cause annoyance to other users; attempt to affect the performance or functionality of any computer facilities of or accessed through this Website; 

– infringe upon the rights of any other person’s proprietary rights or send any unsolicited advertising or promotional material, commonly referred to as ‘spam’.

 

4) Account Registration

VOCLA® reserves the right to close, restrict access to or take any other action against customer accounts, which may result in the forfeiture and destruction of all information associated with you. We will not be liable if for any reason your account is unavailable at any time or for any period.

 

5) Terms of Sale

By placing an order, you are offering to purchase Goods on and subject to the following Terms of Sale. 

5.1. Our Contract

When placing an order, you undertake that all details you provide us are true and accurate.

When you place an order, you will receive an acknowledgement e-mail confirming receipt of your order: this email will only be an acknowledgement and will not constitute acceptance of your order. A contract between us will not be formed until we have received your order, received payment in full and as cleared funds and accepted your order. At this point, a binding legal contract is created, subject to your right of cancellation.

VOCLA® retains the right to cancel any order for any reason. 

5.2. Description, Pricing and Availability

Whilst we try and ensure that all details, descriptions and prices which appear on this Website are accurate, errors may occur.

The description and price of the Goods you order will be as shown on the Website at the time you place your order. Prices include VAT at the United Kingdom’s rate where the purchase is made for delivery within the United Kingdom. Prices do not include VAT where the purchase is made for delivery outside the United Kingdom and therefore no VAT refund, deduction or reclaim will be made.

All orders are subject to availability. If any Goods that you ordered are not available, VOCLA® will inform you as soon as possible and offer you alternatives or the option to cancel those Goods on the order.

If we discover an error in the price of any Goods which you have ordered, we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling the order. If we are unable to contact you or we do not receive an order confirmation within 5 working days, we will treat the order for the Goods as cancelled.

If an order is cancelled or part of an order is cancelled and you have already paid for the Goods, you will receive a full refund in the same manner as the original payment.

Postage and packaging costs may be charged in addition. These charges are clearly displayed at check-out and are detailed on the Deliveries page of the Website.

All prices advertised are subject to change at any time.

5.3. Payment

Payment for the Goods and postage and packaging charges can be made by any method shown on the Website at the time you place your order but you must possess a valid credit or debit card issued by a bank acceptable to us or a verified PayPal account. You must be the authorized user of the credit card, debit card or PayPal account. It is your responsibility to ensure that there are sufficient funds to cover the cost of the Goods and postage and packaging.

Goods will not be dispatched until payment of cleared funds is received. 

5.4. Discount Codes, Promotions & Coupons

5.4.1 Discount Codes

We may from time to time offer promotional discount codes which may apply in respect of any, or certain specified, purchases made through this Website.

The conditions of use relating to any discount code will be specified at the time of issue. VOCLA® reserves the right to vary the terms at any time.

VOCLA® may reject the use of or remove the availability of a discount code at any time and for any reason.

Only one discount code may be used for each purchase.

Discount codes do not apply to postage and packaging charges, sale Goods, discounted Goods, bundled Goods, gift cards, underwear subscriptions, mystery underwear Goods, duty charges or any other fees unless otherwise specified. 

Discount codes must be applied at the checkout and will not be applied retrospectively after payment has been taken for Goods.

Where a discount code has an expiry date and time, the time refers to Greenwich Meridian Time, a London time zone.

Where a transaction has been affiliated with a cashback website (ie you clicked from a cashback website to the VOCLA.com website), and you use a discount code, any cashback will be rejected. You cannot use a discount code and still have cashback.

5.4.2: Coupons

Coupons are valid until the expiry date shown on it and are only valid on the VOCLA.com website.

You can use the coupon to get the item or discount shown on it in a single transaction.

If the coupon states that a qualifying minimum spend is required (for example, £5 off £50 spend) then the coupon can only be used if the qualifying or minimum spend has been achieved in a single transaction.

If the coupon states that a particular category (eg swimwear) or specific item(s) must be purchased, then the coupon can only be used if the particular category or specific item(s) have been purchased in that transaction.

Coupons are not transferable and cannot be exchanged for cash.

Coupons are not valid in coordination with other discount codes or coupons.

Coupons cannot be used, unless stated on the coupon, to purchase gift cards and vouchers, subscriptions, gift wrapping services, delivery fees, or items that are already discounted.

Coupons cannot be applied to a transaction retrospectively. As soon as payment is made, order data is immediately fed to couriers and customs data is automatically generated on export orders, which we are not allowed to change.

Where a transaction has been affiliated with a cashback website (ie you clicked from a cashback website to the VOCLA.com website), and you use a coupon, any cashback will be rejected. You cannot use a coupon and still have cashback.

VOCLA has the right to reject the use of, or withdraw, coupons and cancel offers at any time, for any reason, but in particular to prevent fraud, breaches of these terms and conditions, or dishonesty.

5.5. Deliveries

Goods you order will be delivered to the address you provide when you place your order.

VOCLA® cannot dispatch parcels to International PO Box or drop box addresses.

Deliveries are only made to countries that can be serviced by the United Kingdom’s Royal Mail and its partners and only those listed at the check-out. VOCLA® may withdraw delivery services to any country at any time.

Delivery times are not guaranteed and are subject to any delays resulting from postal delays, Customs processing or force majeure for which we will not be responsible, including any loss or damage suffered by you through reasonable or unavoidable delay in delivery. Please refer to the Delivery Policy for estimated delivery times.

All parcels either have a GPS barcode that is scanned on delivery by the Royal Mail and used to determine the exact location of delivery, a tracking barcode to show the whereabouts of the parcel or a signature service where the recipient signs for acceptance of the parcel. If any of these confirm that a parcel has been delivered and/or signed for receipt on delivery, VOCLA® will not consider the parcel to be lost.

Parcels may be left with a neighbour or can be held at local post offices or postal collection points if the recipient is not available to accept the parcel at the time of delivery.

Tracking details are provided to customers by e-mail when a tracked service is selected as part of the order. Tracking details are also provided by the Royal Mail, by SMS, for UK tracked services, if a correct mobile number and correctly formatted mobile number is given on the order. It is your responsibility to ensure that the correct e-mail address and/or mobile phone number is provided so you can receive the tracking details. VOCLA® cannot be held responsible if e-mails or SMS messages cannot be delivered due to factors outside our control, such as spam filters, firewalls, incorrect e-mail addresses and phone numbers.

Goods are not considered to be lost until after 10 working days for deliveries within the UK and 28 working days past the expected delivery date for International deliveries, if the tracking shows that the Goods have cleared Customs authorities. If Goods are lost, VOCLA® will check all available tracking details and then send replacement Goods if available. It is the policy of VOCLA® to send a replacement Goods if available rather than issue a refund. You must notify us of a missing parcel within 30 days of dispatch. Notification of a missing parcel received after 30 days will be handled at our discretion.

You must tell VOCLA® if a parcel is later delivered that was previously considered to be lost. VOCLA® will consider whether to send a pre-paid mailing bag for you to return those Goods or to re-charge for the Goods.

If you fail to take delivery of the Goods or provided an incorrect or incomplete delivery address which did not allow the Goods to be delivered, we will refund you for the purchase price of the Goods, in the same manner that payment was received, if and when they are returned to us by the postal services, but not for the original cost of postage and packaging. At the discretion of VOCLA®, the cost that VOCLA® paid for any postage, may be deducted from any refund. If you fail to take delivery of the Goods because you cancelled your contract under The Consumer Protection (Distance Selling) Regulations (UK) 2000, as amended, VOCLA® will refund you within 7 days for the purchase price that was paid, in the same manner that payment was received, once the Goods have been returned. On exercising your right to cancel you will be required to return the Goods in line with the Returns Policy. If you fail to return the Goods, VOCLA® will not refund them and reserves the right to deduct any direct costs incurred to retrieve the Goods.

5.6. Customs

When ordering Goods from VOCLA® for delivery outside the United Kingdom, you or the recipient may be subject to import duties, taxes and fees which are levied according to local Customs policies and/or laws. VOCLA® cannot be responsible for the payment of these. 

Any advice or information provided in relation to these charges by VOCLA® should be verified before placing an order. VOCLA® cannot be held responsible for any incorrect advice. Customs policies change on a regular basis, in different countries. It is therefore your responsibility to check what charges may be imposed, before placing an order.

Customs authorities may open and inspect packages.

Customs processing may cause delays to delivery of parcels, of unlimited length. VOCLA® is unable to contact Customs authorities whilst they process a parcel.

VOCLA will not refund the cost of postage on parcels that are returned, where you failed to pay any Customs charges. If you return items on an order, you will need to reclaim any import tax and customs duties directly from your local tax office, VOCLA® cannot reclaim or refund these monies.

5.7. Title and Risk

The ownership of the Goods shall not pass to you until VOCLA® has received cleared funds in full for the purchase price of the Goods plus all other sums which are due. The Goods are at your risk from the time of delivery.  

5.8. Cancellations

You have the right to cancel the contract at any time up to 30 calendar days after you receive the Goods.

To exercise your right of cancellation, you must give written notice to VOCLA®, providing details of the Goods and order.

Except in the case of faulty or miss-described Goods, if you exercise your right of cancellation after the Goods have been dispatched to you, you will be responsible for returning the Goods to VOCLA® at your own cost to the trading address of VOCLA®, ensuring that the Goods are not damaged in the meantime or in transit. If you do not return the Goods as required, VOCLA® may charge you the direct costs of recovering the Goods.

VOCLA® will refund you within 7 days of the Goods being received back. Refunds will be made in the same manner as the original payment.

Refunds do not include the cost of outbound delivery unless the standard delivery option was selected for the order. The standard delivery option is the cheapest delivery option at checkout that was available for your order.

You do not have the right to cancel the contract if the order is for Goods you have worn unless the only way to discover a fault is by wearing or washing the Goods. 

5.9. Returns

You may return Goods in line with the Returns Policy.

You have the right to return Goods at any time up to 30 calendar days after you receive the Goods.

VOCLA® will only accept returns for Goods free of fault received back in a condition suitable for re-selling – unworn, in their original condition and with all tags and original packaging intact and undamaged.

Except in the case of faulty or miss-described Goods, you will be responsible for returning the Goods to VOCLA® at your own cost, using the Returns Form which can be downloaded on the Returns page of the Website. Goods should be returned to the trading address of VOCLA®, for which the address is provided on invoices and the Returns Form. You must take reasonable care to ensure that the Goods are not damaged in the meantime or in transit.

VOCLA® offers the Royal Mail Tracked Returns Service to UK customers who wish to make a return. You can generate a returns label on the Royal Mail website or at a Post Office or Royal Mail Customer Service Point. If you use this service, VOCLA® will reduce the value of your refund by £4. This is the amount that the Royal Mail charges VOCLA®, plus VAT. This service provides proof of return, compensation for loss or damage and tracking. However, you may use other Royal Mail services or couriers to return your items.

Parcels returned from outside the UK are not applicable for Customs charges. These parcels should clearly state ‘Returned Goods’ on the Customs documents and be given a zero value so that Customs charges are not applied in error. VOCLA® will not pay for any Customs charges applied to parcels for returned Goods and the parcel will be rejected on delivery back to VOCLA®.

VOCLA® will refund you within 7 days of the Goods being received back. Refunds will be made in the same manner as the original payment.

Refunds do not include the cost of outbound delivery unless the standard delivery option was selected for the order. The standard delivery option is the cheapest delivery option at checkout that was available for your order.

If a parcel is returned with the incorrect postage on it and incurs a fee which VOCLA® pays, the value of that fee will be deducted from any refund.

Mystery underwear products, gift cards, underwear subscriptions and underwear/swimwear padding cannot be returned.

5.10. Faulty Goods and Miss-Descriptions

In the case of faulty or miss-described Goods we shall, after receiving written notification of the fault or miss-description, ask you to return the Goods yourself and refund your reasonable postage costs or alternatively provide you with a pre-paid mailing bag to return the Goods. If you are able to provide photographic evidence of any fault, we may not then require the Goods to be returned.

In the case of Goods that develop a fault over time, VOCLA® will consider refunds for Goods that were purchased within the last three months. We shall request you to provide photographic evidence of any fault. We may then ask you to return the Goods yourself and refund your reasonable postage costs or alternatively provide you with a pre-paid mailing bag to return the Goods.

VOCLA® will provide replacement or similar alternative Goods where available, to replace faulty Goods. If replacement Goods are not available or where Goods have been miss-described, VOCLA® will refund you within 7 days of the Goods being received back. Refunds will be made in the same manner as the original payment. 

VOCLA® will not provide replacement Goods or refunds where Goods have been washed in a way that is not compliant with the washing instructions on the labels of those Goods. 

VOCLA® will only refund miss-described Goods if they are received back in a condition suitable for re-selling – unworn, in their original condition and with all tags and original packaging intact and undamaged.

VOCLA® will make any refunds due within 7 days of the Goods being received back. Refunds will be made in the same manner as the original payment. 

5.11 Gift Cards

It is your responsibility to select the correct value of the gift card that you wish to send to a recipient, as well as confirming that the correct recipient details, specifically e-mail address, have been input. If the incorrect e-mail address is given for a recipient, you will need to contact VOCLA as quickly as possible to rectify this. Once a gift card has been used, no changes can be made.

Gift cards are non-refundable.

Gift cards are only issued in GBP and are only available for UK resident recipients.

Gift cards have an expiry date 365 days after their issue date.

If your recipient loses a gift card code, the person who paid for the gift card should contact us (not the recipient of the card), in order to retrieve the code.

Gift cards operate a running balance. Therefore, if the recipient does not use the full value of a card on an order, the remaining balance will be available for a future order.

Recipients can add their gift card to an e-wallet balance within their customer account. They can then check or add to their e-wallet balance through their customer account.

To use a gift card, recipients should input the gift card code into the 'coupon & gift card code' box on the basket page, prior to checkout.

5.12 Missing Items

If on delivery, items are missing from an order, you will be required to send a picture of the Royal Mail apology bag or equivalent proof of a damaged parcel (such as a damage label attached by the courier). If this picture is received, VOCLA will dispatch replacement items.

If the parcel was not damaged, VOCLA will check the CCTV at our packing station, to determine whether the order was fully picked, packed and completed. VOCLA will also reconcile the current stock levels for the item(s) that you claim is missing. VOCLA will also check the weight of the parcel on the Royal Mail dispatch system and match this to the collective weight of all items on the order to determine if anything was missing. VOCLA will also review any images taken by the Royal Mail or equivalent courier, on delivery, to view the package for damage or tampering. If there is then sufficient evidence to suggest that the order was dispatched fully complete, with no missing items, no replacement items will be dispatched. VOCLA reserves the right to block the IP address, card fingerprint and e-mail address of the claimant with our payment processor. If other retailers have also reported these, the payment processor may permanently block the ability to pay at all retailers using that payment processor. VOCLA also reserves the right to make a report for fraud.

This Website and its original content, features and functionality are owned by VOCLA® and are protected by international copyright, trademark, patent, trade secret and other intellectual property or proprietary rights laws.

This Website contains material which is owned by or licensed to us. This material includes, but is not limited to, the design, layout, look, appearance and graphics. The intellectual property rights in all software and content made available to you on or through this Website remain the property of VOCLA® and/or its licensors and are protected by intellectual property and copyright laws and treaties around the world. All such rights are reserved by VOCLA® and its licensors. You may view, download for caching purposes only, and print pages from the Website for your own personal use. You are not permitted to publish, distribute, manipulate or otherwise reproduce, duplicate, sell or rent in any format, any of the content or copies of the content supplied to you or which appears on this Website nor may you use any such content in connection with any business or commercial enterprise without the prior written permission of VOCLA®.

You shall not modify, translate, reverse engineer, decompile, disassemble or create derivative works based on any software or accompanying documentation supplied by VOCLA® or its licensors.

The word VOCLA, the phrase VA CLUB, the VOCLA and VA brand logos are all registered trademarks belonging to VOCLA Limited. No license or consent is granted to you to use these marks in any way unless written permission is provided by VOCLA®.

Except where expressly stated to the contrary all persons (including their names and images), third party trademarks and images of third party Goods, services and/or locations featured on this Website are in no way associated, linked or affiliated with VOCLA®. Any trademarks featured on this Website are owned by the respective trademark owners. Where a trademark or brand name is referred to it is used solely to describe or identify the Goods and services and is in no way an assertion that such Goods or services are endorsed by or connected to VOCLA®.

7) Links to and from this Website

You may link to any page of our Website, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.

Information and materials displayed or offered on this Website are provided without any guarantees, conditions or warranties as to its accuracy, timeliness, performance, completeness or suitability. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude any liability for any such inaccuracies or errors to the fullest extent permitted by law, unless expressly stated to the contrary.  We shall not be liable for any damages whatsoever arising out of or related to the use, inability to use, performance or failures of this Website or the Linked Sites and any materials posted thereon, irrespective of whether such damages were foreseeable or arise in contract, tort, equity, restitution, by statute, at common law or otherwise. This does not affect the liability of VOCLA® which cannot be excluded or limited under applicable law.

We will not be liable for any loss or damage caused by a distributed denial-of-service attack, viruses or other technologically harmful material that may infect your computer equipment, computer programs, data or other proprietary material due to your use of this Website or to your downloading of any material posted on it, or on any website linked to it.

 

9) Indemnity

You agree to indemnify, defend and hold harmless VOCLA®, its directors, officers, employees, consultants, agents, and affiliates, from any and all third party claims, liability, damages and/or costs (including, but not limited to, legal fees) arising from your use of this Website or your breach of the terms and conditions.

 

10) Variation

VOCLA® shall have the right in its absolute discretion at any time and without notice to amend, remove or vary the Services and/or any page of this Website.

 

11) Invalidity

If any part of the terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of the terms and conditions will not be affected. All other clauses remain in full force and effect. So far as possible where any clause/sub-clause or part of a clause/sub-clause can be severed to render the remaining part valid, the clause shall be interpreted accordingly. Alternatively, you agree that the clause shall be rectified and interpreted in such a way that closely resembles the original meaning of the clause /sub-clause as is permitted by law.

 

12) Waiver

If you breach these terms and conditions and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these terms and conditions.

 

13) Governing Law and Jurisdiction

These terms and conditions are to be construed in accordance with the laws of England and in the event of any dispute or claim associated with these terms and conditions, that dispute or claim shall be subject to the exclusive jurisdiction of the English courts.

 

14) Entire Agreement

The above terms and conditions, together with our Privacy Policy, constitute the entire agreement between you and us and supersede any and all preceding and contemporaneous agreements between you and VOCLA®. Any waiver of any provision of the terms and conditions will be effective only if in writing and signed by a Director of VOCLA®.

  • If gift wrapping is damaged in transit, please inform us so we can provide replacement wrap;

  • It is your responsibility to inform us before 3pm GMT, by e-mailing contact@vocla.com, if:

Therefore, the system can determine that this is your first order.

1) In General

These VA CLUB terms and conditions, together with the VOCLA Terms and Conditions and VOCLA Privacy Policy govern how VOCLA Limited (‘VOCLA®’) conducts business with you in relation to the VA CLUB, a men’s underwear subscription service, operated by VOCLA Limited.
The term ‘VA CLUB’ refers to the Services and Goods provided by the VOCLA® subscription service.
The terms ‘VOCLA’, ‘we’, ‘us and ‘our’ refer to VOCLA Limited. VOCLA Limited’s registered office is Unit 2, Tilson Road, Roundthorn Industrial Estate, Manchester, UK, M23 9GF, and whose company registration number is 07910951, registered with the Registrar of Companies for England and Wales.
The terms ‘you’ and ‘your’ refer to the subscriber of the VA CLUB Subscription.
The term ‘Website’ refers to www.VOCLA.com.
By using the services of the VA CLUB (collectively, the ‘Services’) and purchasing products (collectively, the ‘Goods’), you are agreeing to all of the VA CLUB Terms and Conditions set out on this page and the VOCLA Privacy Policy.
VOCLA® may change these VA CLUB Terms and Conditions at any time without prior notice. You should check these terms regularly to take notice of any changes made. Your continued use of the Website and your Subscription to the VA CLUB after any such changes constitutes your acceptance of any new VA CLUB Terms and Conditions.
Where the VA CLUB Terms and Conditions require you to provide written notification to VOCLA®, this can be done by e-mailing contact@vocla.com

2) VA CLUB Subscription

The VA CLUB is a men’s underwear subscription service.
The VA CLUB is available for delivery to the countries listed within the Further Answered Questions on the VA CLUB page of the Website. VOCLA® has the right to change the countries to which the VA CLUB is available at any time, either by way of a temporary suspension or removal of Services. VOCLA® will inform you if this affects you and offer a cancellation or alternative Service.
When you subscribe to the VA CLUB, you will select the number of pairs of underwear, the waist size, the style (jockstrap, brief or boxer) and the frequency (every month or every quarter) that you wish to receive Goods.
The date of the month that you place your initial Subscription will become the date that we take payments for future Subscriptions (your ‘Payment Date’). If your Payment Date is on 31st of a month, payment will be taken on the last day of each month. Your credit or debit card details that you specify for your initial Subscription and/or update within your account over time, will become your ‘Payment Method’.
These selections and choices collectively become your ‘Subscription’.
VOCLA® will select underwear for you each month. You will not be aware of what that underwear will be, other than the selections that you have made for your Subscription – the number of pairs, the size and the style.

3) VA CLUB Account

As a subscriber of the VA CLUB, you are provided with an online account (your ‘VA CLUB Account) where you can manage your Subscription at www.VOCLA.com (the ‘Website’).
You can change your Subscription selections within your online VA CLUB Account or by contacting VOCLA®. Changes need to be made prior to your next Payment Date for those changes to take effect.
Access to your VA CLUB Account is permitted on a temporary basis, and we reserve the right to withdraw or amend the Services without notice and for any reason, including access to your VA CLUB Account, which may result in the forfeiture and destruction of all information associated with you. We will not be liable if for any reason your account is unavailable at any time or for any period.

4) Terms of Sale

By creating a Subscription with the VA CLUB, you are offering to purchase Goods and receive Services subject to the following VA CLUB Terms and Conditions.

4.1. Our Contract

When subscribing, you undertake that all details within your VA Account are true and accurate.
When you subscribe, you will receive an acknowledgement e-mail confirming your Subscription.
A contract between us to provide each Subscription, will not be formed until we have received payment in full and as cleared funds for that month’s or quarter’s Subscription.
VOCLA® retains the right to cancel and refund any Subscription for any reason and at any time.

4.2. Pricing

Your Subscription fee along with any postage and packaging costs are detailed on your initial e-mail confirmation of your Subscription and within your VA CLUB Account.
The Subscription fee is inclusive of VAT at the United Kingdom’s rate if delivery of your Subscription is within the United Kingdom. Your Subscription fee does not include VAT, if delivery of your Subscription is outside the United Kingdom and therefore no VAT refund, deduction or reclaim will be made.
Subscription prices are set at the time of your initial Subscription. Prices are subject to change at any time, but VOCLA® we will give you at least 30 days’ notice and offer you the option to cancel your Subscription. Future subscribers may be offered a different price. You may cancel your Subscription and re-start a new Subscription at a new price if you wish.

4.3. Payment

Your Subscription fee along with any postage and packaging costs is taken as a recurring payment on your Payment Date.
Payment can be taken by any method shown on the Website, but you must possess a valid credit or debit card issued by a bank acceptable to us. You must be the authorized user of the credit or debit card. You may change the payment method within your VA CLUB Account in advance of your Payment Date. VOCLA does not accept payment by Klarna, Clearpay or PayPal for subscription products.
It is your responsibility to ensure that there are sufficient funds to cover the cost of the Subscription. If your payment method fails for any reason, we will attempt to take payment each week for two weeks following your Payment Date, after which your Subscription will be cancelled or paused.
For debit/credit card payments, you will be e-mailed 7 days prior to a subscription renewal and when your card is due to expire, so this can be updated.
Goods will not be dispatched until payment of cleared funds is received.

4.4. Discount Codes and Promotions

We may from time to time offer promotional discount codes which may apply to the VA CLUB.
The terms and conditions of use relating to any discount code will be specified at the time of issue. VOCLA® reserves the right to vary the terms at any time.
VOCLA® may reject the use of or remove the availability of a discount code at any time and for any reason.
Only one discount code may be used for each purchase. Discount codes do not apply to postage and packaging charges, unless otherwise specified.
Discount codes must be applied at the time and place that they are valid and will not be applied retrospectively after a payment has been taken for Goods or Services.
If a subscription is made using a discount code or any other discount, and the subscription is cancelled before dispatch, VOCLA® reserves the right to not dispatch the subscription box and to refund the subscriber instead, on the basis that this behaviour indicates that the customer had no real intention of subscribing.

4.4.1. Recurring Discounts
Where a recurring discount is applied (ie a discount over a set number of payments), the subscription cannot be cancelled during that period. If the subscription is switched to another style, the recurring discount won’t roll-over to the new style.

4.4.2. First Box Discount
Where a discount is given on the first box, that deal is limited to one use per subscriber. The first box dispatched will be made up from previous months’ subscription products. Therefore, if a current subscriber subscribes to another box, they are likely to receive a product that they have already received.

4.5. Deliveries

Once payment has cleared in full, VOCLA® aims to dispatch your Subscription within 3 working days.
Your Subscription will be delivered to the address given on your VA CLUB Account. It is your responsibility to ensure that the delivery address is correct. You can change your address prior to your Payment Date by either contacting VOCLA® or by changing your delivery address within your VA CLUB Account.
Deliveries are only made to locations that can be serviced by the United Kingdom’s Royal Mail and its partners. VOCLA® cannot dispatch parcels to PO Box or drop box addresses. VOCLA® may withdraw delivery services at any time.
Delivery times are not guaranteed and are subject to any delays resulting from postal delays, Customs processing or force majeure for which we will not be responsible, including any loss or damage suffered by you through reasonable or unavoidable delay in delivery. Please refer to the Further Answered Questions section on the VA CLUB Website page for estimated delivery times.
All parcels either have a GPS barcode that is scanned on delivery by the Royal Mail and used to determine the exact location of delivery, a tracking barcode to show the whereabouts of the parcel or a signature service where the recipient signs for acceptance of the parcel. If any of these confirm that a parcel has been delivered and/or signed for receipt on delivery, VOCLA® will not consider the parcel to be lost.
Parcels may be left with a neighbour or can be held at local post offices or postal collection points if the recipient is not available to accept the parcel at the time of delivery.
Tracking details are provided to customers by e-mail when an International tracked service is selected as part of the Subscription. Tracking details are provided by e-mail. It is your responsibility to ensure that the correct e-mail is provided so you can receive the tracking details. VOCLA® cannot be held responsible if e-mails cannot be delivered due to factors outside our control, such as spam filters, firewalls and incorrect e-mail addresses.
Goods are not considered to be lost until after 10 working days for deliveries within the United Kingdom and 20 working days past the expected delivery date for International deliveries, if the tracking shows that the Goods have cleared Customs authorities. If Goods are lost, VOCLA® will check all available tracking details and then send replacement Goods if available. It is the policy of VOCLA® to send replacement Goods if available rather than issue a refund. You must notify us of a missing parcel within 30 days of dispatch. Notification of a missing parcel received after 30 days will be handled at our discretion.
You must tell VOCLA® if a parcel is later delivered that was previously considered to be lost. VOCLA® will consider whether to send a pre-paid mailing bag for you to return those Goods or to re-charge for the Goods.
If you fail to take delivery of the Goods or provided an incorrect or incomplete delivery address which did not allow the Goods to be delivered, we will contact you to re-arrange delivery. You may be charged the additional cost of delivery. At the discretion of VOCLA®, the cost that VOCLA® paid for any postage, may be deducted from any refund.

4.6 Customs

When ordering Goods from VOCLA® for delivery outside the EU you or the recipient may be subject to import duties, taxes and fees which are levied according to local Customs policies and/or laws. VOCLA® cannot be responsible for the payment of these.
Customs authorities may open and inspect packages.
Customs processing may cause delays to delivery of parcels, of unlimited length. VOCLA® is unable to contact Customs authorities whilst they process a parcel.

4.7. Title and Risk

The ownership of the Goods shall not pass to you until VOCLA® has received cleared funds in full for your Subscription plus all other sums which are due. The Goods are at your risk from the time of delivery.

4.8. Cancellations

You have the right to cancel your Subscription at any time prior to your Monthly Payment Date through your online VA Account or by informing VOCLA® in writing.

4.9. Returns and Exchanges

The VA CLUB does not allow returns or exchanges due to the intimate nature of underwear products, for hygiene reasons and because the VA CLUB is based on the premise that you receive mystery underwear selected by VOCLA®, effectively at a discount to the recommended retail price. It is your responsibility to ensure that the selections you make within your VA CLUB Account for size, style and quantity remain appropriate.
In the case of faulty Goods we shall, after receiving written notification of the fault, ask you to return the Goods yourself and refund your reasonable postage costs or alternatively provide you with a pre-paid mailing bag, access to a Tracked Returns Service or pre-paid postage label to return the Goods. If you are able to provide photographic evidence of any fault, we may not then require the Goods to be returned.
In the case of Goods that develop a fault over time, VOCLA® will consider refunds for Goods that were purchased within the last three months.
VOCLA® will provide replacement Goods where available, to replace faulty Goods. If replacement Goods are not available, VOCLA® will either provide an alternative or refund you.
But VOCLA® will not provide replacement Goods or refunds where the washing instructions of Goods have not been correctly followed or where it is considered that there has been unreasonable care or wear and tear.
Any refunds due within 7 days of the Goods being received back or within 7 days of our agreement to refund you. Refunds will be made in the same manner as the original payment.
